These Terms of Service (“Terms”) govern your access to and use of MeeGo Pay, including the MeeGo Pay mobile application, website, QR payment services, payment services and related features (collectively, the “Platform”).

MeeGo Pay is operated by FAMA Technologies Company Limited (“FAMA”, “MeeGo Pay”, “we”, “us” or “our”).

By creating an account, accessing the Platform or using any MeeGo Pay service, you agree to these Terms. If you do not agree with these Terms, you should not use MeeGo Pay.

1.About MeeGo Pay#

MeeGo Pay is a digital payment platform designed to enable users to make and receive payments electronically.

Depending on the features available to you, MeeGo Pay may allow you to:

  • Create an individual or business account;
  • Link an eligible bank card;
  • Make payments by scanning a MeeGo Pay QR code;
  • Receive payments through your MeeGo Pay account;
  • Set a mobile-money account as a payout method;
  • View payment and transaction history;
  • Generate and share a MeeGo Pay QR code;
  • Receive transaction notifications and payment confirmations; and
  • Access other payment-related services introduced by MeeGo Pay from time to time.

A MeeGo Pay user may act both as a payer and a recipient. We do not require separate customer and merchant accounts for the basic service.

2.Third-party payment providers#

MeeGo Pay may use licensed third-party payment service providers, payment processors, banks, card networks, mobile-money operators and other financial infrastructure providers to process transactions.

These providers may be responsible for functions including:

  • Card payment processing;
  • Payment authentication;
  • Transaction authorization;
  • Card settlement;
  • Mobile-money disbursement;
  • Bank transfers;
  • Transaction verification; and
  • Other payment infrastructure services.

MeeGo Pay may use third-party payment service providers

Your use of the Platform may therefore also be subject to the applicable terms and policies of those providers.

3.Eligibility#

You must provide accurate information when creating your account.

You may be required to meet identity-verification, age, business-registration or other eligibility requirements before using particular features.

MeeGo Pay may restrict or decline access where required by law, regulation, payment-provider requirements, risk controls or our internal security procedures.

4.Your MeeGo Pay account#

You are responsible for maintaining the security of your account.

You agree to:

  • Provide accurate and current information;
  • Keep your login credentials confidential;
  • Keep your MeeGo Pay PIN confidential;
  • Never share your PIN with another person;
  • Notify us promptly if you suspect unauthorized access;
  • Ensure that your mobile phone and email account are secure; and
  • Use your account only for lawful purposes.

You are responsible for activity carried out through your account unless you have promptly notified us of unauthorized access and the applicable investigation establishes otherwise.

5.Identity verification#

To comply with applicable legal, regulatory, security and payment-provider requirements, MeeGo Pay may require you to provide information for identity or business verification.

This may include:

Individual users

  • Full name;
  • Telephone number;
  • Email address;
  • Identification information;
  • Date of birth where required;
  • Other information required for verification.

Business users

  • Business name;
  • Business registration information;
  • Owner/director information;
  • Business contact information;
  • Identification documents;
  • Other information required for business verification.

We may use third-party verification providers where necessary.

Failure to complete required verification may result in limitations on your account.

6.Bank cards#

You may be able to link an eligible bank card to your MeeGo Pay account.

For security purposes, MeeGo Pay shall not store your complete card number or CVV where card-tokenization services are available.

Card information may be handled by our authorized payment processor in accordance with applicable security requirements.

MeeGo Pay may store limited card information such as:

  • Card brand;
  • Last four digits;
  • Expiry information where necessary; and
  • A secure payment-provider token or reference.

You authorize MeeGo Pay and its payment providers to process transactions initiated by you through the Platform.

7.Payments#

When making a payment, you are responsible for confirming:

  • The recipient;
  • The amount;
  • The applicable fees;
  • The payment method; and
  • The transaction details before confirming the payment.

Once a transaction has been authorized and processed, it may not always be possible to cancel it.

You should carefully review payment information before entering your PIN or otherwise authorizing a transaction.

8.MeeGo Pay QR codes#

MeeGo Pay may provide users with a unique QR code.

A QR code may identify the intended payment recipient.

Scanning a MeeGo Pay QR code does not by itself authorize a payment.

The payer must review the recipient and amount and complete the required payment authorization process.

You must not:

  • Alter another person’s QR code;
  • Replace a QR code with a fraudulent QR code;
  • Use another person’s QR code to misrepresent yourself;
  • Create fraudulent payment instructions; or
  • Use MeeGo Pay QR codes for unlawful activities.

MeeGo Pay may suspend or disable a QR code where we reasonably believe it has been compromised or misused.

9.Fees#

MeeGo Pay may charge transaction fees for using its services.

Unless otherwise stated at the time of a transaction, MeeGo Pay currently intends to charge a 3% MeeGo Pay transaction fee.

In addition to the MeeGo Pay fee, a transaction may incur:

  • Card/payment-processing fees;
  • Mobile-money disbursement fees;
  • Bank or network charges;
  • Applicable taxes; and
  • Other disclosed third-party processing costs.

The applicable fees should be displayed to the payer before final authorization where technically possible.

Fees may vary depending on the payment method, provider, transaction type, currency, network or regulatory requirements.

MeeGo Pay may change its fees by providing appropriate notice or displaying updated fees before future transactions.

10.Payment collection and payout#

A payment may involve two separate stages:

Collection: receiving the payment from the payer.

Payout: transferring the applicable amount to the recipient’s registered payout method.

A successful collection does not necessarily mean that the payout has already been completed.

For example, a transaction may have:

Payment: Successful
Payout: Pending

MeeGo Pay may delay, review or suspend a payout where necessary to:

  • Verify the transaction;
  • Prevent fraud;
  • Resolve a technical issue;
  • Comply with legal requirements;
  • Respond to a payment-provider issue; or
  • Investigate a disputed transaction

11.Failed transactions#

A transaction may fail for reasons including:

  • Insufficient funds;
  • Card decline;
  • Failed authentication;
  • Payment-provider error;
  • Network failure;
  • Timeout;
  • Incorrect recipient information;
  • Mobile-money payout failure;
  • Account restrictions;
  • Fraud or security controls; or
  • Other technical or regulatory reasons.

Where money has been debited but the transaction is not successfully completed, MeeGo Pay will work with the relevant payment provider to determine the transaction status and, where applicable, process a reversal or refund.

Processing times may depend on the payment provider, card network, bank or mobile-money operator.

12.Refunds and reversals#

Refunds and reversals may be available where:

  • A transaction failed after funds were debited;
  • A duplicate transaction occurred;
  • A transaction is reversed by the payment provider;
  • A refund is authorized by the recipient; or
  • A refund is required by applicable law.

The availability and timing of a refund may depend on the payment method and the relevant payment provider.

MeeGo Pay does not guarantee an immediate refund where a third-party payment provider must first investigate or process the reversal.

13.Unauthorized transactions#

If you believe that a payment was made without your authorization, you should contact MeeGo Pay immediately.

You may be asked to provide:

  • Transaction ID;
  • Date and time;
  • Amount;
  • Account information;
  • Supporting information; and
  • Any other information reasonably required to investigate the transaction.

You should also contact your bank or card issuer where appropriate.

14.Acceptable use#

You agree not to use MeeGo Pay to:

  • Commit fraud;
  • Launder money;
  • Finance illegal activities;
  • Obtain money through deception;
  • Process unauthorized card transactions;
  • Use stolen cards or financial credentials;
  • Circumvent payment controls;
  • Impersonate another person or business;
  • Manipulate transactions;
  • Create fraudulent QR codes;
  • Interfere with the Platform;
  • Attempt unauthorized access;
  • Introduce malicious software;
  • Abuse another user’s account; or
  • Violate applicable laws or regulations.

MeeGo Pay may suspend or terminate accounts involved in prohibited activity.

15.Suspension and account restrictions#

We may suspend, restrict or terminate an account where we reasonably believe that:

  • The account has been compromised;
  • The account is being used fraudulently;
  • The user has violated these Terms;
  • Required identity verification has not been completed;
  • The account presents a security or financial risk;
  • A payment provider has restricted the account;
  • We are required to do so by law or regulatory authorities; or
  • Continued access could cause harm to MeeGo Pay, another user or a third party.

Where appropriate and legally permitted, we will provide information regarding the reason for a restriction.

16.Service availability#

We aim to keep MeeGo Pay available and reliable, but we do not guarantee uninterrupted service.

The Platform may become unavailable because of:

  • Maintenance;
  • Internet failures;
  • Mobile-network failures;
  • Bank or card-network outages;
  • Payment-provider outages;
  • Mobile-money outages;
  • Cybersecurity incidents;
  • System upgrades; or
  • Other circumstances outside our reasonable control.

17.Payments and customer responsibility#

When making a payment through MeeGo Pay, you are solely responsible for carefully reviewing and confirming all payment information before authorizing the transaction.

Before confirming a payment, you must verify:

  • The beneficiary/recipient name displayed on the payment screen;
  • The amount you have entered;
  • The applicable MeeGo Pay and third-party fees;
  • The payment method; and
  • Any other transaction details displayed to you.

You should only authorize the transaction after confirming that all information is correct.

By entering your PIN or otherwise providing the required authorization, you confirm that you have reviewed and approved the displayed transaction details.

18.Customer acknowledgement#

By using MeeGo Pay, you acknowledge and agree that:

1. You are responsible for entering the correct payment amount.

2. You are responsible for selecting the correct beneficiary.

3. You must verify the beneficiary’s name before authorizing payment.

4. You must verify the amount before authorizing payment.

5. A successfully authorized payment is generally final.

6. MeeGo Pay may not be able to reverse a successfully collected payment where the error was caused by you entering an incorrect amount or selecting the wrong beneficiary.

7. You should not authorize a payment unless you are satisfied that all displayed transaction details are correct.

8. If you notice an error before authorization, do not enter your PIN or otherwise authorize the transaction. Cancel the payment and start again.

19.Failed transactions#

A transaction may fail because of:

  • Insufficient funds;
  • Card decline;
  • Failed authentication;
  • Payment-provider error;
  • Network failure;
  • Timeout;
  • Incorrect recipient information;
  • Mobile-money payout failure;
  • Account restrictions;
  • Fraud or security controls; or
  • Other technical or regulatory reasons.

A failed transaction is different from a successfully completed payment.

Where a customer has been charged despite the transaction being recorded as failed, MeeGo Pay will investigate the transaction with the relevant payment provider and take the appropriate action, including reversal or refund where applicable.

20.Refunds and corrections#

MeeGo Pay does not guarantee refunds for payments that were successfully authorized because of a customer’s mistake in entering the payment amount or selecting the beneficiary.

However, a refund, reversal or correction may be considered where:

  • The payment was unauthorized;
  • The customer was charged more than once for the same transaction;
  • A technical error occurred within the MeeGo Pay system;
  • A payment provider incorrectly processed the transaction;
  • The transaction failed but the customer’s card was nevertheless charged;
  • Fraud or another security incident is established;
  • A reversal is required by applicable law or payment-network rules; or
  • The beneficiary voluntarily agrees to return the funds.

Where a beneficiary voluntarily agrees to return funds, MeeGo Pay may facilitate or coordinate the process where technically and operationally possible.

Refunds or reversals may take time to complete because they may require action by the relevant card issuer, payment processor, bank, mobile-money operator or other financial institution.

21.Third-party services#

MeeGo Pay may depend on third parties for payment processing, identity verification, hosting, telecommunications, mobile money, card networks and other services.

We are not responsible for failures caused exclusively by third-party systems outside our reasonable control.

However, MeeGo Pay will make reasonable efforts to investigate and resolve transaction issues involving those providers.

22.Electronic communications#

using MeeGo Pay, you agree that we may communicate with you electronically through:

  • The MeeGo Pay application;
  • Email;
  • SMS;
  • Telephone;
  • Push notifications; and
  • Other electronic communication methods associated with your account.

Electronic records and communications may be used to provide transaction confirmations, security alerts, service updates and other important information.

Uganda’s Electronic Transactions Act recognizes electronic records and electronic transactions within its legal framework.

23.Intellectual property#

MeeGo Pay, including its software, branding, logos, designs, text, graphics and other content, is owned by or licensed to FAMA Technologies Company Limited or its respective licensors.

You may not copy, modify, distribute, reverse engineer, sell or commercially exploit MeeGo Pay except where expressly permitted by law or by FAMA.

24.Privacy#

Your use of MeeGo Pay is also governed by our MeeGo Pay Privacy Policy, which explains how we collect, use, store, protect and share personal information.

The Privacy Policy forms part of these Terms.

25.Limitation of liability#

To the extent permitted by applicable law, MeeGo Pay will not be responsible for losses arising solely from:

  • Your failure to protect your account credentials;
  • Incorrect payment information entered by you;
  • Unauthorized sharing of your PIN;
  • Third-party bank or mobile-network failures;
  • Payment-provider outages;
  • Events outside our reasonable control; or
  • Your unlawful use of the Platform.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

26.Changes to these terms#

We may update these Terms from time to time.

When material changes are made, we may notify users through the Platform, email, SMS or another appropriate method.

Your continued use of MeeGo Pay after the effective date of an updated version constitutes acceptance of the updated Terms, to the extent permitted by law.

27.Governing law#

These Terms shall be governed by the laws of the Republic of Uganda.

Any dispute shall be handled in accordance with applicable Ugandan law.

By creating a MeeGo Pay account or using the Platform, you confirm that you have read, understood and agreed to these Terms of Service.
